Your use of this Website, isleande.com, and your purchase of any of the products from it, is subject to the terms and conditions and privacy policy set out below, which you accept by using this website. Please note, the terms and conditions can potentially change at any time, and it is up to you to check the terms and conditions regularly before ordering products in case there are any changes. If you do not agree with the terms and conditions set out below (including the use of cookies), you should not use or access this Website. 

These terms and conditions apply to the entire contents of this website. Please read these terms carefully before placing an order. Placing an order indicates that you accept the terms.

1. GENERAL INFORMATION

1.1 Isleande sells products through www.isleande.com, therefore, your contract for purchases made through this Website is with Isleande & Co. and you undertake that all products ordered by you are for your own private and domestic use only and are not for resale.

1.2 By placing an order through this Website, you agree that email can be used as a long-distance means of communication and you warrant that:

  • (a) you are at least 18 years old;
  • all information you provide to Isleande when ordering or purchasing products is true, accurate, current and complete in all respects; and
  • that the credit or debit card you are using is your own and that there are sufficient funds in your account to cover payment of the product(s) ordered.

1.3 On certain parts of this Website, Isleande may require you to register and provide certain information about yourself and where you do this you agree to:

  • provide true, accurate, current and complete information about yourself as prompted by the relevant registration form (such information being the Registration Data); and
  • maintain and promptly update the Registration Data (by updating it on this Website in the ‘my account’ section, or by sending an appropriately worded email to hello@isleande.com) to keep it true, accurate, current and complete.

1.4 Where information (including sensitive financial or personal information) is provided to Isleande (whether directly through this Website or otherwise) you accept that these methods of communication cannot be 100% secure. Where sensitive financial information is provided encryption software is used to attempt to prevent unauthorised access to this information being obtained. In the unlikely event of a breach in the secure computer servers, Isleande cannot accept any responsibility or liability for any claims, losses or damages arising from the misuse or loss of data or information submitted by you to Isleande directly through this Website or otherwise. The provision of personal information by you and use of it by Isleande is subject to Isleande’s Privacy Policy.

1.5 The registration processes on this Website will involve you being allocated with a unique username and/or password that gives you access to your website account. You are responsible for maintaining the confidentiality of your username and password, and are fully responsible for all activities that occur through your website account. You agree to:

  • immediately notify Isleande if you become aware of any unauthorised use of your password or website account or any other breach of security by sending an appropriately worded email to hello@isleande.com; and
  • ensure that you log off from your website account at the end of each session, Isleande cannot and will not be liable for any claims, loss or damage of any nature whatsoever, including indirect, consequential or economic losses of profit arising from your failure to comply with these requirements.

1.6 Isleande reserves the right to end its agreement with you and to suspend or terminate your access to this Website immediately and without notice if:

  • you fail to make payment to Isleande when it is due;
  • you breach any of these terms and conditions;
  • when requested by Isleande to do so, you fail to provide within a reasonable time frame, enough information to let Isleande check the accuracy and validity of any information supplied by you, or your identity; and/or
  • Isleande suspects you have engaged, or are about to engage, or have a way of being involved in fraudulent or illegal activity on this Website.

2. PRODUCT INFORMATION, AVAILABILITY AND PRICES

2.1 Isleande takes care to ensure that the information on this Website is accurate and complete but please note that product colours and details may vary from the image(s) shown on the Website.

2.2 Isleande tries to ensure that the product colour is as accurate as possible, but the colours shown may vary depending upon the setting of your computer monitor or product availability. Isleande cannot guarantee that the colour shown will accurately reflect the colour upon delivery and cannot be held responsible or liable for any differences in colour or minor details between the image and the actual product.

2.3 Isleande does not promise that products advertised on this Website are necessarily available, and all products are offered for sale are subject to acceptance and availability.

2.4 All prices listed on this Website are correct at the time of entering the information, however, Isleande reserves the right to change the price of any product at any time. All prices include sales tax (if applicable) but exclude delivery charges which are payable by you. Any currencies other than Euro (€) on this Website are for guidance only and all payments shall be made Euro (€) and must be paid in full, including delivery charges, except where discounts are offered as detailed on this Website or otherwise in correspondence from Isleande.

3. ORDERING

3.1 Once you click on the “Place Order” button Isleande will treat the order as an offer by you to purchase the products subject to these terms and conditions. You are responsible for ensuring the accuracy of your order.  Please note that this does not mean that your order has been accepted but is simply a confirmation that Isleande has received your offer to purchase the product(s).

3.2 No contract for the sale of any product will exist between you and Isleande until Isleande accepts your order by dispatching the product(s) to you. Isleande will confirm the acceptance by sending you a dispatch confirmation email to the email address given in your order form and will detail the product(s) ordered, cost (including VAT (if applicable) and postage and packaging charges) and usual delivery times. You must check all the details on this confirmation email are correct and contact Isleande as soon as possible if any details are incorrect.

3.3 Any products on the same order, which Isleande has not confirmed in a dispatch confirmation email, do not form part of that contract. Isleande will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate dispatch confirmation email.

3.4 Isleande reserves the right to refuse an order. Non-acceptance of an order may be as a result of one of the following:

  • (a) the product ordered being out of stock;
  • inability to obtain the authorisation of payment or failing security checks;
  • the identification of an error within the product information, including price and promotion;
  • you not meeting the eligibility to order as set out in these terms and conditions; and/or
  • Isleande being unable to fulfill an order(s) to countries other than the Finland for whatever reason.

3.5 If your order has not been accepted, you will receive an email from Isleande telling you the reasons why.

3.6 In the event that a product is out of stock, you will be informed as soon as practically possible. Where all products in an order are unavailable and/or Isleande chooses not to accept the order for any of the reasons stated in condition 3.4 the order relating to the unavailable product will be cancelled and a full refund will be made including any delivery charges. Where some products in an order are unavailable, those that are available will be dispatched and a refund will be made for those that are unavailable. Delivery charges will still apply.

4. DELIVERY

4.1 The delivery period stated within which you will receive your order is approximate and no guarantee as to delivery within a certain time frame is given. Products will be sent to the address given by you in your order and risk of damage to or loss of the products shall pass to you at the time of delivery even if the products have not been received by you in person. If you are ordering more than one product, your products may be sent to you in installments if certain products are out of stock.

4.2 If your delivery address is outside Finland and the EU, you may have to pay import duties and taxes, which are levied once the delivery reaches your country. You must meet any additional charges for customs clearance; Isleande has no control over these charges and cannot predict their amount. Please note customs policies vary widely from country to country. Isleande recommends that you contact your local customs office for further information.

4.3 Please note international shipments may be subject to cross-border inspections by customs authorities. You must comply with all applicable laws and regulations of the country for which the products are destined. Isleande will not be liable for any breach by you of any such laws.

5. PAYMENT

Checkout Finland Oy acts as a collecting payment service provider and is an authorized Payment Institution. Checkout Finland Oy will be shown as the recipient on your bank or credit card statement. Checkout Finland Oy will forward the payment to the merchant.

5.1 Bank Payments
You have access to payment buttons for all Finnish banks. You can pay with the payment buttons of Aktia, Danske Bank, Handelsbanken, Nordea, Savings Bank, Cooperative Bank, POP Bank, Savings Bank, S Bank and Ålandsbanken. Checkout Finland Oy will appear as your payee in your account statement, and we will pass your payment on to the online merchant. From the online store, you are directed directly to your bank to make a secure payment.

Checkout Finland also offers the opportunity to pay with a bank transfer form.

5.2 Credit Card Payments
You can pay online at Visa, Visa Debit, Visa Electron, MasterCard, Debit MasterCard and American Express. The online shop uses Verified by Visa, MasterCard SecureCode and American Express SafeKey authentication services.

Checkout is displayed as a payee on a card invoice and passes the payment card payment made by the customer directly to the merchant. Card payment is done securely on a secure payment form and the payment card information is not stored in e-commerce systems.

All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Isleande, Isleande will not be liable for any delay or non-delivery.

Card Payments will be made in Euro (€). The currency converter for other currencies is for guidance only. You should contact your payment card company for exact information about their exchange rates. Isleande is not responsible for any exchange rate or extra commission that may be charged by your credit card company  

5.3 Mobile Payment
Mobile Payment Pivo, MobilePay, Masterpass, and Transfer are application-based services that allow you to pay for online purchases by credit transfer from your account or card payment from your card by accepting a payment in that application. In addition, Pivo is successful in transfer payments, so payment can be accepted in any application that supports Transfer.

5.4 GSM-payment

Ainapay: the service is based on the use of 060605 payment service numbers. Payment is made by calling the payment service number and following the voice announcements.

The price of the service is specific to the service number and includes the price of the product and the billing fee related to the service. In addition to the price of the service, the customer pays the normal mobile charge according to the pricing of its own mobile operator. GSM payment purchases are charged to the user's telephone bill.

Restrictions on the use of the service / mobile subscription:

  • Single purchase up to € 52.32 (incl. VAT)
  • Monthly shopping up to € 100 (incl. VAT)
  • Up to two purchases per day
  • Not working with prepaid subscriptions

5.5 Invoice and installment services
Invoice and installment services through Checkout are provided by OP, Collector, Jousto and Mash (formerly Euroloan). Collector also offers invoice and installment options for corporate customers.

6. PROMOTIONAL CODES

Promotion codes are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other promotion code or offers, and must be redeemed by the date published, if provided. Promotional codes cannot be applied retrospectively to previous orders.

7. RETURNS PROCEDURE

7.1 You may return a product within 14 days of the delivery date. In order to return a product you must comply with the following conditions:

  • email hello@isleande.com within 14 days of the delivery date;
  • the product must not have been used, worn, washed nor damaged and must be in a resalable condition;
  • return the product in the original packaging and with the tags attached and intact.

7.2 Any other returns will be handled on an individual case basis. Please inform us by an e-mail, which includes your order ID number. You will receive instructions on how to proceed via e-mail. We cannot accept returns due to slight color or size differentiations. If by chance the item is damaged during the transport, please notify us within 24 hours of receiving the parcel, and please make sure to send us a picture of the damage.

7.3 You are responsible for the product(s) until they are received at the return address and thus you are advised to use a special delivery service when returning products and to retain their proof of postage until receipt is confirmed by email.

7.4 If you wish to cancel your order or return any products (for a refund) you must return the products to Isleande at your own cost. Where incorrect or damaged products are received by you Isleande will refund the price of a defective product in full and any applicable delivery charges subject to Isleande being satisfied that the products are incorrect or damaged.

7.5 On receipt of the returned products to the return address Isleande will examine the returned products and their conformity with the Return Conditions and will confirm any cancellation or return by email within a reasonable period of time. Isleande will process the refund due to you as soon as possible and, in any case, within 30 days of the day Isleande confirmed to you by email that you are entitled to a refund.

7.6 Isleande will refund any money received from you using the same method originally used by you to pay for your purchase.

8. THIRD PARTY SITES

8.1 Isleande may provide links on this Website to the sites of other companies, whether affiliated with Isleande or not. Isleande cannot give any undertaking that companies to whose website Isleande has provided a link on this Website, will be of satisfactory quality, and any such warranties are disclaimed by Isleande absolutely. This disclaimer does not affect your statutory rights against the third party.

8.2 Isleande cannot be held responsible for material displayed on third party websites or any other written material. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

9. LIABILITY

9.1 Isleande does not accept liability for any errors and/or omissions contained in this Website and reserves the right to change information, prices, specifications and descriptions of listed products and services at any time and without notice.

9.2 If an error is discovered in the price of the products that you have ordered, Isleande will inform you as soon as possible. Isleande has no obligation to fulfill an order for a product that was advertised at an incorrect price. In the event that you order a product and the price published on this Website is incorrect for any reason, Isleande will email you to inform you that it has not accepted your order, and that your order has been cancelled. You will be advised of the correct price of the product and you may re-order it if you wish. If you have already paid for the products in the circumstances described in this condition 11.2, Isleande will refund the full amount within 30 days of the date of order. Should you choose to re-order at the correct price, a separate transaction will be required.

9.3 In the unlikely event that you receive products which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, Isleande will rectify any shortage or non-delivery, replace or repair any damaged or defective products, or refund to you the amount you paid for the products in question provided that you notify Isleande of the problem in writing at hello@isleande.com within 14 days of delivery of the products and return the products to Isleande at the return address.

9.4 The products sold on this Website are provided for private domestic and consumer use only. Accordingly, Isleande does not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of this Website or for any products or services purchased from this Website.

9.5 Isleande shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside Isleande’s reasonable control, including but not limited to acts of God, war, flood, fire, storm or other natural disaster, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, terrorist attack or threat of terrorist attack, explosion, governmental actions, impossibility of the use of public or private telecommunications networks, pandemic and any other similar events.

9.6 Isleande makes no warranty that this Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of this Website. Isleande will not be responsible or liable to you for any loss of content or material uploaded or transmitted through this Website.

9.7 To the fullest extent permissible under applicable law, Isleande disclaims any and all warranties of any kind, whether express or implied, in relation to the products. 

9.8 Isleande will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the conditions for:

  • any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
  • any loss of goodwill or reputation; or
  • any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.

9.9 Nothing in these terms and conditions shall exclude or limit Isleande’s liability for death or personal injury resulting from Isleande’s negligence or that of its servants, agents or employees.

10. COPYRIGHT

All rights, including copyright, in the content of this Website are owned or controlled by Isleande. In accessing this Website, you agree that you may only download the content for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in any way the content of this Website for any other purpose whatsoever without the prior written permission of Isleande.

11. WAIVER

11.1 If Isleande fails, at any time during the term of a contract, to insist upon strict performance of any of your obligations under the contract or any of these terms and conditions, or if Isleande fails to exercise any of the rights or remedies to which Isleande is entitled under the contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.

11.2 A waiver by Isleande of any default will not constitute a waiver of any subsequent default.

11.3 No waiver by Isleande of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing by Isleande.

12. SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

13. ENTIRE AGREEMENT

13.1 These terms and conditions and the Privacy Policy constitute the whole agreement between you and Isleande.

13.2 You and Isleande each acknowledge that, in entering into a contract, neither of you rely on any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions.

13.3 You and Isleande agree that Isleande’s only liability in respect of those representations and warranties that are set out in these term and conditions (whether made innocently or negligently) will be for breach of contract.

13.4 Nothing in this condition 15 limits or excludes any liability for fraud.

14. LAW AND JURISDICTION

14.1 These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Finland.

14.2 Contracts for the purchase of products through this Website and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be settled in accordance with Finnish law. 

15. THIRD PARTY RIGHTS

A person who is not party to these terms and conditions or a contract shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999. 

We are committed to protecting your privacy and we comply fully with the requirements of the Data Protection Legislation. We do not collect any personal information except where it is specifically and knowingly provided by you with your consent. We only collect personal information that is necessary to process and fulfill your orders or undertake the facilities offered by this web site.
